Before depositing money with a sports betting website, verify the company behind it and the licence covering its activities in Kenya. A familiar brand, an advert or a working M-PESA payment option does not establish current licensing status.

This guide explains how to check an operator. It does not label a list of brands as currently licensed without a current regulator record supporting each entry.

Who regulates betting in Kenya?

The Gambling Control Act, 2025 established the Gambling Regulatory Authority of Kenya (GRA). It commenced on 26 August 2025 and replaced the former Betting, Lotteries and Gaming Act framework, with transitional provisions for existing licences and certain matters.

The 2025 Act recognises roles for both national and county governments. It is therefore misleading to describe GRA as the only authority involved in every aspect of gambling premises and permits. GRA is the national regulator to consult when checking a Kenyan online betting operator.

Parliament’s repository also records the Gambling Control (Licensing) Regulations, 2026, Legal Notice 111. For a consumer checking a site, the crucial question is the licence currently covering that specific operator, activity and period—not simply whether the operator once appeared on an older list.

How to check a betting website

  1. Identify the operator. Read the site’s licence statement and terms. Record the legal company name, trading name, licence number and exact website address. A brand and its legal operating company can have different names.
  2. Consult the regulator. Start with the GRA website and its licensed-operators page. Check the period covered by any published list or notice.
  3. Match the details. Confirm the company, licence category, validity period and website or platform covered. A licence for a different activity or an expired period is not enough.
  4. Resolve uncertainty directly. If the record is unavailable, old or unclear, use contact details published on GRA’s official site to request confirmation. Do not assume either that a site is licensed or that it is illegal merely because a webpage fails to load.
  5. Check notices and terms. Look for relevant suspension or revocation notices. Read withdrawal conditions, identity-verification requirements, bonus restrictions and the operator’s complaints procedure before depositing.

Older BCLB lists and copies of 2025/26 records should not be treated as proof of a licence valid today. The Act contains transition provisions, and the relevant licence period must be checked.

Warning: A licence logo can be copied. Local payment methods, foreign payment methods or cryptocurrency acceptance do not, on their own, prove or disprove Kenyan licensing.

Taxes on betting deposits and withdrawals

These are separate deductions. Sources checked on 3 November 2026 show:

Tax What it applies to
5% excise duty Amounts deposited for betting or gaming, as described in KRA’s Finance Act 2026 guidance
5% withholding tax on punters’ withdrawals Withdrawals covered by the Income Tax Act’s betting and gaming provisions

KRA’s published Income Tax Act text lists the 5% withdrawal rate in the Third Schedule. Do not describe this as a tax charged only on a bet’s profit. Other gambling activities can have different tax treatment, and an operator or payment provider may also have charges separate from tax.

Read the deposit or withdrawal breakdown before confirming a transaction and retain statements if you need to query a deduction. Use current KRA guidance rather than an old article quoting the former tax on betting winnings.

Limits and complaints

Sports betting is for adults aged 18 and over. Treat it as an activity with a real risk of losing money, not a way to pay debts or earn a dependable income. Keep rent, food, school fees and borrowed money out of betting. Use spending limits or self-exclusion options if available, and stop if gambling is harming your finances or relationships.

For an account dispute, keep transaction references, screenshots of the applicable terms and your correspondence. Complain to the operator first, then use the regulator’s official complaints route if the issue remains unresolved. Licensing is not a guarantee of winning or of a favourable complaint outcome.
