Kenyan citizenship is governed by the Constitution and the Kenya Citizenship and Immigration Act. The main constitutional categories are citizenship by birth and citizenship by registration. Marriage and lawful residence are routes to registration; they do not grant citizenship automatically.

Citizenship by birth

A person is a citizen by birth if either parent was a Kenyan citizen when the person was born, whether the birth occurred inside or outside Kenya. The Constitution also provides a presumption of citizenship for a child found in Kenya who appears under eight and whose nationality and parents are unknown.

Registration through marriage

A person married to a Kenyan citizen for at least seven years may apply, subject to the legal conditions and documentary checks. The marriage must be legally recognised and genuine. Immigration provides a specific checklist for this route.

Registration through lawful residence

A foreign national with at least seven years of continuous lawful residence may be eligible to apply. Residence alone is insufficient: the Act and Immigration’s checklist impose additional conditions and supporting evidence.

Other routes and regaining citizenship

There are separate provisions for adopted children, children of registered citizens and specified stateless-person or migrant cases. Use the relevant category rather than assuming every application follows the residence route.

A Kenyan citizen by birth who lost citizenship through acquiring another nationality before the 2010 Constitution may apply to regain it. A foreign permanent-residence document, such as a US Green Card, is not itself citizenship.

How to apply

  1. Read the official citizenship guidance.
  2. Select the route matching your circumstances and assemble its current checklist.
  3. Follow Immigration’s official application link and submit the required evidence.
  4. Pay only through the instructions issued for your application and respond to verification requests.

Tip: Eligibility to apply does not mean an application is already approved. Keep your immigration status valid while the application is considered.
